The F.B.I.,the T.B.I.,The D.A."s office ALL investigated and reviewed this incident and NO charges were filed and a JUDGE found,after reviewing ALL the evidence that they get their job back!!That's good enough for me!!

Thing is , IF they go back they gonna be walkin a 11/7 beat on suck creek road till they retire!!

The man who was evidently high on cocaine was feeling little pain and was violent. There is a reason police are given a baton and it is not for decoration. They are trained to use the baton to beat you into submission when you are violent and will not obey the officer.

There is a real violent criminal world out there. I wish feel good Liberals would learn about it.

Jesse, it was an low-level administrative law judge (ALJ), which is not the same as a judge on the bench of a state or federal court. And, the opinions and rulings of all lower court judges are subject to appeal.

Why is a judge making fire or hire decisions in an employment at will state? Apparently the police chief and others considered termination was appropriate and if so the decision should stand. What applicable laws did the ALJ refer in making this employment decision?

Over and over and over again the man was told to put his hands behind his back and to roll over while the officers were standing at a distance but the man refused to obey.

The two officers got down on the floor with the man and were wrestling with him trying to handcuff him but were not able to subdue him.

It was only then they started to use their batons on him and the man would still not obey.

Numerous other officers arrived and made no effort to stop the officers so evidently they saw no police procedure being violated.

As Chief Dodd testified, there was plenty of opportunity for the cops to handcuff the guy after they slammed him to the ground. He wasn't resisting, he was trying to defend himself against an assault as anyone would.

Chief Dodd also testified that officers are NOT trained to beat people into submission as Conservative stated. The judge must have been asleep or playing Farmville through most of the hearing.

Fool. They carry guns, too. That doesn't mean they have the right to shoot someone for not rolling over. The guy was not fighting back, he was as limp as a wet dish rag. The cops were beating the living hell out of him simply because he was refusing to obey their specific command to roll over. Those guys were not Barney Fife. They were big and strong and could have forcefully cuffed him. Granted, someone high on drugs or mentally disturbed can be deceptively strong, but even so, those guys were sufficiently strong enough and capable of cuffing him without pulverizing him with repeated blows. They were obviously out of control and were mostly just p#ssed off from his insubordination of not obeying their specific command. He was not fighting back, he was merely refusing to roll over. That does not justify 40+ brutal blows to the body and breaking both his legs!

I am not a cop-hater. I respect most cops and appreciate them (the good ones, at least) for putting their lives on the line to protect and serve, and I understand how difficult and dangerous their job is. PT's and con-man's insinuation that this is a case of liberals resorting to knee-jerk cop-bashing couldn't be more stupid and absurd. I know and have talked to righties and lefties alike, including a couple of ex-cops, who have come to the same conclusion about these cops - that they went way over the line and their actions were inexcusable.

In case you've not seen the video, take a look. In addition to the beating, the two cops are out of breath after 30 seconds. Were the cops tested for steroids?

To those who support this type of beating, I hope these two get to arrest your sons and daughters.

This is reason I suggest you always video every interaction with law enforcement. Without video, this would have been swept under the thin blue rug.

It's also the reason all cops should be tested monthly for drugs.

Too many cops get on a power-trip and use intimidation as a way to be a bully. I have had numerous run-ins with the law because of my propensity to ride motorcycles at excessive speed. Without a doubt, the Tennessee Highway Patrol always acted with total professionalism. It was often the local deputy that could not. Perhaps it is the difference in training.

Ever try getting mouthy and LOUD after a judge says a cop is wrong?

I contested a policeman once and the judge ruled against him. That cop was after me for the next ten years. Never worked. :)

You keep saying that...as if what those cops did is excusable because the guy refused to "roll over." Every situation is different and cops are supposed to be trained how to handle someone like that guy Tatum - obviously high on drugs and maybe even autistic, like someone mentioned - without beating him to within inches of his life. He was not physically threatening them, not fighting them in any way. He was just lying there, refusing to "roll over." Those cops were big and strong and if they couldn't forcibly handcuff him themselves there were plenty of other cops around who could have helped them (most of the beatings were taking place after other cops were on the scene). And the cops even kicked him after he was handcuffed.

Yes, jesse, we all know that we should be nice and do what the cops say, otherwise we'd best be prepared to get a baton-whuppin'. You care to tell us again for the umpteenth time??

Fairmon these are two very damn good questions. I have been looking for answers and haven't been able to find any. Don't bother looking in Judge Summers decision because you won't find a logical statement in the whole damn thing. It's just 30 pages of nonsense boo-hooing about how badly those two clowns were treated and how Tatum brought the whole thing on himself. She cites not one rule of conduct or law that I could find that justified re-instating these hydrocephalic morons, she just up and did it. I have read the entire criminal code section of the Tennessee code annotated and the entire Chattanooga city criminal code and NOWHERE IN EITHER is there ANY law that says a cop can do to you what these two cretins did. I now carry a 650,000 volt stun gun and a video camera everywhere I go because I refuse to be the next victim of this hole above grounds' so-called "police dept". They have the biggest egos and the smallest testicles of any police dept. I have ever had the misfortune to have to deal with and I can only think that void in between the two is filled to the brim with anabolic steroids. I would advise every citizen of this "municipality" to go armed with a weapon capable of dealing with them legal or not.

It won't be long before a case of a civilian killing a cop in self-defense happens in Chattanooga.

If the honest cops wish to protect themselves they'd best eliminate the sociopaths and thugs in their ranks.

Otherwise, one day a jury will begin finding those who hurt and kill cops 'not guilty' by reason of self-defense.

Without a doubt, some cops have gotten away with murder. Some innocent civilians have been sent to jail or death-row for self-defense against thugs such as Emmer and Cooley.

These two banditos-in-blue, should they return to the CPD, should be required to wear electronic monitoring devices and have live video cameras attached to their chests so that their actions can be monitored continuously.

All police should be given monthly drug tests. These two appear to be raging steroid users — all bulk, no brains, who live for 'stick time' and opportunities to physically abuse civilians.

Equally sickening is that no other cop attempted to stop the brutality.

they can disagree all they want the constitutions defines where tax bills start. I don't believe they ruled on where it started just whether if it was a tax. and since it is, it should have originated in the house of representatives and since it didn't it violates article 1 section 7.

All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

it doesn't hold water to people such as yourself who have no ideal why the constitution was written.

Now that it's apparent to everybody what's going on with cops and the government in this country, Maybe some of you who concerned about surviving your next encounter with a cop might be willing to read something with an open mind that has a rather radical title. I don't know how long the Times Free Press will let it stay up so I would suggest copying the link description if you are not so brainwashed that you literally cannot THINK about resisting law enforcement. Every thing is diff. now from in my day! Now they look like SS troopers esp. the swat guys and i think that has had an effect on the attitude of both the cops and the public! When i was a cop we all had fairly long hair and cookie dusters and kinda more laid back attitude! That said we had no cam corders to lookout for and over all the dept had a better public image then than now!Been 35 years ago so i guess it's changed!

As what seems to occur more and more, going against the 'submit to authority' narrative will, I believe, classify him as domestic terrorist in the near future.

One such example: "The ultimate hypocrisy of statists is that they advocate constant, widespread initiation of violence against everyone (via "government"), while at the same time condemning as "violent" any talk of forcibly resisting tyranny."

I completely agree. But you act as if we who are calling these cops out for the thugs they are are by default defending Tatum. We all know that he's a thug himself, with a lengthy criminal record. Nobody is justifying or making excuses for his actions. But those cops unwittingly made him a martyr because they went to such brutal extremes in how they handled the situation.

Cops wield an incredible amount of power, and even if they are totally in the wrong and you feel justified in resisting arrest or fighting back, ninety-nine times out of a hundred, you are going to lose. But because they have so much power there is all the more reason to make certain the bad cops are weeded out to whatever extent that is possible. That's why it's so unsettling to see that these cops are most likely going to be reinstated.

The judge had no legal basis for the decision. The concern should be about judges deciding whom an employer will hire, fire, retain and whatever with their no business or supervisory experience they decide which gives them a warm and fuzzy feeling. Judges tend to think they are a small deity or all knowing Solomon that can rule as they please. An ALJ, the bottom rung, of the judgeship ladder are among the worst followed by appointed for a lifetime senile federal judges.

Fairmon, There MUST be some legal basis for it since it been going on since at least from the 1950's ! Also if it ain't legal why is the city going to have to appeal it! I'm no lawyer but i don't think the city would appeal it if it wasn't binding!

jesse..unfortunately an ALJ ruling is binding. A judges ruling is binding regardless of whether there is a legal basis for a ruling or not. The problem is some judges penchant for making law where there is no law supporting their personal opinion and where other applicable laws could apply. Thank goodness there is an appeal process and surely to hell the mayor and the city leaders will approve and support an appeal. Read the ALJ rambling ruling to see what I mean.

jesse....think about it, judges make and twist laws at their pleasure. The SCOTUS just ruled for the first time governments can tax citizens for not buying something. Those liking Obama care applauded the ruling. But, when some government decides to tax anyone not buying an electric car so they can subsidize those that do they may not be so ecstatic. I predict California will be the first state to use the "non-purchase" tax precedence set by the SCOTUS for something other than healthcare. SCOTUS essentially supported the government saying You will buy healthcare insurance or a tax will be imposed on you in order to supplement those that do procure healthcare coverage. A dangerous precedence if you are a tax payer.

I would personally love to be part of an effort to load her IP's server down so much that she would have to stop using her e-mail service. We need to harass her to the point that she just has to leave this town permanently. There's a dozen things I could think of to do that would leave her no choice but to pull up stakes and go.

She is married to some Lawyer named Paul Summers who works for the big wig law firm called Waller,Lansden,Dortch & Davis and their offices are in Nashville so anybody with friends in Nashville call em up and ask if they could look up these offices and maybe ID their cars, follow them home and find out where they live etc.

There are the rules of conduct and laws that gave her the right to reinstate these officers.

I now carry a 650,000 volt stun gun and a video camera everywhere I go because I refuse to be the next victim of this hole above grounds' so-called "police dept". They have the biggest egos and the smallest testicles of any police dept. I have ever had the misfortune to have to deal with and I can only think that void in between the two is filled to the brim with anabolic steroids. I would advise every citizen of this "municipality" to go armed with a weapon capable of dealing with them legal or not.

Attitudes like yours usually produce one of two results. A ride in the meat wagon or sobbing in the backseat of a patrol car. Since you won’t be able to video either would you get a helpful bystander to use your camera to do so. I’m absolutely sure it is going viral on the internet.

Any individual that has not properly identified himself as a law officer and asks what I am doing is going to get a response that they will not like. Just ask an undercover Jackson County sheriff's deputy and the TBI agent that was with him. Both in a clapped out Z28 Camaro wearing plain clothes. I finally had to ask "Who the hell are you?" They had to separate me and the young punk TBI agent. I was fully within my rights and they knew it. They did not write me a speeding ticket for going probably 85 in a 45 on my crotch-rocket. They were out of line and did not want to answer for their "cowboy" actions. If Zimmerman had confronted me... I would have told him to FU#@ OFF. If he laid a hand on me, I would have beat him to a pulp.

Is this the kind of B.S. that passes for adult macho conversation when you and your fellow “organ donors” have expended all of your personal “Isle of Man” glory tales. Thus reduced to standing on the side of the road pi$$ing down each other legs and scratching you a##es to get the feeling to return?

The city charter or code is not a law. The charter or code is a guide for the cities elected officials. What in this case is the unjust or arbitrary cause?

Administrative procedures are for administrators and are not legally binding. The termination of the two officers is legal in Tennessee which is an employment at will state. The city has multiple reasons for appeal and will prevail if they appeal as they should. They are not in a protected class therefore their termination was not illegal.

I don't know or care if they are guilty of beating the crap out of some low life or not. The point is some wimpy wuss hired as an ALJ should not be the decision maker in a legal hiring or termination by any employer.

Am I going to be required to copy and post all 4 pages plus each code, regulation, and rule that is referenced. I clearly said that was the quote that leads off the 4 pages and was not it’s entirety. It can’t possibly be that difficult for you to go to the link and read the information for yourself. These judges have every legal right to address these issues when it come to public employees. The fact that you don’t like it does not change that in any way.

I have read the ruling which is a convoluted rambling. I haven't said there was no authority on the part of the administrative process, unfortunately they can impose their less than objective opinion which is not binding for a period allowing an appeal. I hope an appeal is forthcoming and in chancery court instead of the less than balanced administrative process.
